Traders Licence Conditions

Farmers Market Traders Licence Conditions



1. Products may only be sold by the principle producer, his/her family or an employee who is directly involved in production.

2. No bought-in produce or commercially made mixes allowed, and whenever possible local ingredients or raw materials should be used. Stallholders may only sell from the stall the goods that have been agreed by the market organisers.

3. All stallholders must have their own public and product liability insurance cover to the value of £5million.

4. Local growers associations and umbrella organisations such as The Women’s Institute may appoint a representative to sell pooled produce on a shared stall, provided that the goods on sale are clearly labelled with the producer’s contact details.

5. The Council or appointed Market Manager may make scheduled visits to places of production to verify compliance with the ‘producer only’ rule. Complaints of suspect violations of this rule must be submitted to the market organiser and signed. Refusal to permit reasonable visits to a property will result in suspension or expulsion from the market.

6. Only certified organic producers can trade under the ‘organic’ label. Those producers in conversion are required to make this clear to the consumer.

7. Only good quality craftwork, plants and wholesome produce at a fair price should be on sale.

8. All goods need to be well presented and displayed.

9. Stallholders shall keep their stalls and surrounding area clean and tidy, and remove all litter and waste from their pitch and adjoining open space at the end of the market.

10. All stalls must display business/group name and address, and where products are produced.

11. All products offered for sale must be labelled, priced and sold according to legal requirements. If you are unaware of the requirements for weights and labelling, information is available from your local Trading Standards Office.

12. All stalls and produce should comply with the Food and Safety (General Food Hygiene) Regulations 1995 and the Food Safety Act 1990. This includes a No Smoking rule for those selling produce. For further information please call the Environmental Health Department.

13. Stallholders selling drinks containing alcohol need to carry their own licence. To gain more information contact your local Magistrates Court. Written proof required on the day.

14. The Council or Market Manager reserves the right to determine in its absolute discretion the stallholders to be allowed to operate in the market.

15. Stallholders are only permitted to sell produce using stalls provided by the Council or Market Manager, unless prior consent is given by the Market Manager to use other facilities or vehicles.

16. Stallholders shall pay in advance of each market the appropriate stallage fee upon booking. Failure to make payment in advance will result in your booking being placed on a waiting list.

17. The Market Manager reserves the right to allocate pitches to stallholders and to determine their location.

18. Stall structure will be erected, allocated and sited for the stallholders by 7am and finished off by 8am.

19. The Market Manager shall be entitled to reallocate stalls where stallholders fail to arrive at the market site by the commencement of trading, unless the stallholder has obtained prior consent from the Market Manager to a late arrival.

20. Each stallholder will be allowed vehicle access to their site for loading and unloading purposes, and will then be required to park their vehicle in an allotted car park for the duration of the market. Some markets offer free parking while others a parking fee is required.

21. The use of electricity must be arranged with the Market Manager in advance of the markets. Not all markets have electricity made available. Please see market  page for details.

22. Stallholders wishing to sell direct from a vehicle must notify the Market Manager giving at least three days notice.

23. Stallholders are not permitted to alter, damage, deface or interfere with any stall, unless the stall is their own property.

24. Stallholders must not place any goods beyond 1 (one) meter distance from the sides or front of the stall without prior consent from the Market Manager, nor cause any obstruction to other stallholders or the public.

25. Stallholders may not add lighting or heating apparatus to any stall without the prior consent of the Market Manager.

26. Stallholders are not permitted to close down or pack up during the market trading hours without the prior consent of the Market Manager.

27. No vehicles will be permitted to use the market site during trading hours without the consent of the Market Manager.

28. Stallholders shall vacate the site as soon as possible after trading ceases.

29. No aggressive selling techniques will be permitted, and stallholders are not allowed to use any public address systems, noisy or polluting engines or other practices which may cause annoyance to other producers or customers.

30. No raffles or games of chance shall be permitted without the prior consent of the Council.

31. No political propaganda or the raising of any petitions etc will be allowed on any stall or other part of the market.

32. The Market Manager reserves the right to cancel or terminate without any market in the event of severe weather conditions or other emergency situations.

33. The Market Manager reserves the right to immediately terminate the right to trade of any stallholder failing to comply with any of these conditions or fail to comply with any reasonable directions given by the Market Manager.

34. No refunds or compensation shall be paid to stallholders who fail to attend a market by the commencement of trading or where the Market Manager has exercised his right to cancel or terminate a market due to severe weather conditions or where a stallholder has been instructed to cease trading due to non-compliance with any of these conditions. When a market is cancelled due to security issues (i.e. acts of terrorism) no advance payment will be carried forward or refunded.

35. Stallholders shall indemnify Market Management & Stall Hire Ltd, its Officers and the Market Manager from all costs and claims whether for loss, damage, death or injury to persons, personal belongings or vehicles arising from the stallholder exercising the licence.
